These Terms of Service ("Terms") govern the relationship between Screenshot Marketing s.r.o. ("Operator," "we," or "us") and any person ("User" or "you") accessing or using the Services available at snapee.ai. By registering for or using the Services, you confirm that you have read these Terms in full, that you understand and agree to be bound by them, and that you meet the eligibility requirements set out in Section 1.

1. Eligibility

The Services are available exclusively to persons who:

• are at least 18 years of age, or the age of majority in their jurisdiction if higher;
• have full legal capacity to enter into binding contracts;
• access the Services in compliance with all applicable laws of their jurisdiction;
• have not been previously suspended or permanently banned from the Services.

2. Absolute Prohibition on Content Depicting Minors

ZERO TOLERANCE. IMMEDIATE PERMANENT BAN AND MANDATORY LAW ENFORCEMENT REPORTING.

• Generating, storing, distributing, or otherwise handling any sexual or nude content depicting persons under 18 — real or fictional — is strictly prohibited.
• This prohibition covers fictional, animated, cartoon, manga, hentai, or AI-generated characters that are or could reasonably be perceived as under 18.
• Attempting to bypass technical safeguards or manipulate prompts to lower the apparent age of depicted characters is prohibited.

These acts are criminal offenses under Czech Act No. 40/2009 Coll., EU Directive 2011/93/EU, the US PROTECT Act, and equivalent laws worldwide. The Operator will always report violations to law enforcement.

3. Account Registration & Security

You agree to provide accurate and complete information during registration (including a valid email address) and to maintain its accuracy. You are solely responsible for safeguarding your login credentials and for all activity occurring under your account. Notify us immediately at hello@snapee.ai or via Discord if you suspect unauthorized access. You may delete your account at any time from Settings → Profile; deletion is permanent and removes your messages, generated characters, and remaining tokens.

4. Tokens, Subscriptions & Payments

The Services run on a token-based usage model (tokens are also referred to as "credits" in some places). Tokens are consumed when you take chargeable actions inside the platform, for example sending a chat message, generating a photo, or creating a new AI companion. Current per-action prices are displayed in the product UI and may be updated from time to time with prior notice.

Subscription Plan

Snapee offers a single subscription tier, billed monthly or annually:

• AI Companion Pro — Monthly: $12.99 / month, includes 2,000 tokens granted per billing cycle.
• AI Companion Pro — Annual: $119.99 / year, includes 2,000 tokens granted per billing cycle (billed once up front, ~23% savings vs. monthly).

Tokens included with a subscription are granted at the start of each billing cycle and do not roll over between cycles unless expressly stated.

One-Time Token Top-Ups

In addition to (or independent of) a subscription, you may purchase one-time token packs that are added to your wallet immediately on a successful payment. Top-up tokens do not expire and remain in your wallet until used or until the account is terminated under Section 5.

• Spark: $3.99 (500 tokens)
• Boost: $9.99 (1,500 tokens)
• Surge: $29.99 (5,000 tokens)
• Mega: $79.99 (15,000 tokens)

Payment & Auto-Renewal

• All payments are processed securely through Stripe.
• Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date through Settings → Billing.
• One-time token top-ups do not renew automatically — each pack is a single discrete purchase.
• The Operator reserves the right to change pricing, plan contents, or token costs with prior notice.

Refund Policy

• Subscriptions. Subscription fees are refundable only if the upcoming billing period has not yet started, or where a refund is required by mandatory consumer-protection law. The first day of a paid period is treated as the start of that period.
• Token top-ups. Because top-up tokens are a digital good delivered to your wallet immediately upon payment, top-up purchases are generally non-refundable once any of the purchased tokens have been spent. Unused, untouched packs may be refunded at the Operator's discretion within 7 days of purchase.
• No refund will be issued in cases of account termination due to violation of these Terms.
• If you believe you were charged in error, contact us at hello@snapee.ai or via Discord within 7 days of the charge.

5. Termination & Suspension

You may cancel your subscription at any time through your account Settings → Billing.

The Operator may immediately suspend or permanently terminate your account for: violation of these Terms (including Section 2); fraudulent or harmful activity; failure to pay; or if required by law. No refund will be issued for terminations due to Terms violations.

6. Intellectual Property

All rights to the platform, its design, source code, and trademarks belong to the Operator or its licensors. Content generated by the User — excluding prohibited content — belongs to the User, who bears full legal responsibility for it. The User grants the Operator a limited, non-exclusive license to store and process generated content solely for the purpose of providing the Services.

7. AI Limitations & Disclaimers

The Services include AI-generated text (chat replies from companions), AI-generated images (avatars and in-chat photos), and other AI-driven features. All AI output is produced by machine-learning models based on the inputs you provide and is probabilistic by nature.

• AI companions are fictional. They are not real people, are not conscious, and any statement they make about their identity, feelings, history, or expertise is fictional roleplay output from a language model.
• We do not guarantee the accuracy, reliability, completeness, appropriateness, or safety of any generated text or image. AI may produce inaccurate, repetitive, off-character, or unexpected content.
• AI output must not be relied on for medical, legal, financial, psychological, safety, or other professional advice.
• All generated content is intended strictly for adults (18+). By using the Services, you confirm you are of legal age and that accessing such content is lawful in your jurisdiction.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for:

• Content generated by Users — the User bears sole and exclusive responsibility.
• Damages arising from unauthorized access caused by the User's failure to maintain credential security.
• Indirect, incidental, special, consequential, or punitive damages.

The Operator's total aggregate liability shall not exceed the amount paid by the User in the preceding 12 months.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Czech Republic. Disputes shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to the courts of the Czech Republic.

EU consumers may use out-of-court dispute resolution through the Czech Trade Inspection Authority (www.coi.cz) or the EU ODR platform (ec.europa.eu/consumers/odr). UK consumers may use applicable ADR schemes.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by email or prominent website notice at least 30 days before taking effect. Continued use after changes take effect constitutes acceptance.
